Firm Broadens Capabilities In Response to Increased Demand
Uniondale, Long Island, New York, April 6, 2009 – Ruskin Moscou Faltischek announced today it has undertaken a major expansion of its white collar criminal practice with the addition of three criminal defense attorneys: Bradley Gerstman, David Schwartz and William McDonald. Practice group co-chairs and partners Alexander G. Bateman and Gregory J. Naclerio lead the practice.

Alexander G. Bateman has 20 years' experience investigating, prosecuting and defending a broad array of federal and state criminal cases. His experience includes trials and appeals of all manner, including healthcare and mortgage fraud, Medicaid / Medicare fraud, environmental crimes, computer crimes, embezzlement, political corruption, RICO and enterprise corruption. Prior to joining the firm, Bateman was a trial attorney with the Suffolk County District Attorney's Office where he was also cross-designated as an Assistant United States Attorney and investigated and prosecuted white collar fraud, official corruption, organized crime, narcotics, vehicular / DWI crimes and sex crimes.

Gregory J. Naclerio is a senior partner at Ruskin Moscou Faltischek and has practiced criminal law for 37 years. He is a certified fraud examiner and was the regional director of the Attorney General's Medicaid Fraud Control Unit on Long Island. For the past 21 years Naclerio has practiced white-collar criminal law at Ruskin Moscou Faltischek including the defense of anti-kickback, Medicare/Medicaid fraud and corporate fraud cases. He has lectured for the New York State Bar and has authored numerous articles on the subject of white-collar crime.

David M. Schwartz has spent his entire career practicing criminal law, both as a prosecutor with the Brooklyn District Attorney's office and as a criminal defense attorney. Schwartz has successfully tried dozens of cases, including high profile murder cases. The media frequently calls upon Schwartz to provide legal analysis on criminal and constitutional issues. Schwartz has argued appeals in the New York State Appellate Division, First and Second Departments and the United States Court of Appeals. Schwartz currently serves as Commissioner to the Commission on Judicial Nomination; and is on the Board of Trustees of the Brooklyn Bar Association and on the board of the Criminal section of NYS Bar.

William J. McDonald has over ten years experience handling criminal cases. He represents clients who are accused of healthcare fraud, Medicaid fraud, street crimes, environmental crimes, and RICO in both state and federal court. He has had extensive prosecuting experience at both the Nassau and Suffolk County District Attorney's office. His prosecutions took him into federal court, where he served as a Special Assistant United States Attorney. Mr. McDonald's investigative experience encompassed extensive use of electronic surveillance, investigative subpoenas, search warrants, wiretaps and pen registers.

Bradley L. Gerstman is Of Counsel to Ruskin Moscou Faltischek. Gerstman started his career as an Assistant District Attorney in the Bronx, where he investigated high profile corporate fraud and corruption cases and prosecuted violent crimes. He has defended a wide variety of criminal cases and investigations in both State and Federal Court and has represented many companies in the course of governmental investigations and has conducted internal investigations that have uncovered fraud, waste and abuse by employees of private corporations.

Melvyn B. Ruskin founded the firm of Ruskin Moscou Faltischek, P.C., in 1968 after serving for several years as a homicide trial attorney for the New York County District Attorney's Office. He is a senior partner and member of the firm's Health Law Department and active in the corporate law arena. Mr. Ruskin practices extensively in the area where corporate business law intersects with the activities of hospitals, other health care providers and health plans. He also has extensive experience in representing clients under investigation for alleged commercial and business-related crimes.
