Jonathan is an experienced litigator dedicated to helping clients achieve favorable results through practical, strategic solutions across a broad spectrum of commercial, construction, liability, and insurance disputes. He has represented clients in state and federal courts throughout New York and New Jersey, with experience at both the trial and appellate levels.
Jonathan counsels and represents clients in a wide range of complex commercial and contractual disputes. While always prepared to advocate aggressively when litigation is necessary, he takes the time to understand each client’s business objectives and develops creative, cost-effective strategies designed to resolve disputes efficiently whenever possible, avoiding unnecessary litigation where appropriate.
He also regularly defends professionals against claims involving negligence, professional malpractice, breach of contract, fraud, breach of fiduciary duty, and statutory causes of action, including RICO claims. His clients include attorneys, accountants, insurance agents and brokers, real estate professionals, and construction and design professionals. In addition, Jonathan represents licensed professionals in disciplinary proceedings, including attorney grievance matters.
Jonathan has extensive experience defending clients against high-exposure bodily injury and property damage claims, with a particular focus on catastrophic injury cases arising from construction accidents. He routinely handles matters involving New York Labor Law §§ 200, 240, and 241(6), and is well versed in the complex risk transfer, indemnification, and insurance coverage issues that frequently accompany construction litigation. His litigation experience also includes product liability, premises liability, and negligent security claims. Over the course of his career, Jonathan has represented manufacturers, distributors, and retailers in product liability litigation involving both industrial equipment and consumer products.
In addition to his litigation practice, Jonathan serves as trusted coverage counsel to insurers, providing coverage analyses and strategic guidance on complex, high-exposure errors and omissions and general liability claims. He has extensive experience advising primary and excess insurers, as well as reinsurers, on coverage issues and claims handling.
Prior to joining Ruskin Moscou Faltischek, Jonathan was a partner at a national law firm, where he represented clients in complex litigation throughout the state and federal courts of New York and New Jersey.

- D’Adamo v. Cohen, (2d Dep’t 2024) (succeeded in securing affirmance of order which granted client’s motion to dismiss legal malpractice claim arising from underlying real estate matter on the basis that the plaintiff failed to viably alleged proximately caused damages.
- Kruetzberg v. Law Offices of John Riconda, P.C., 210 A.D.3d 884 (2d Dep’t 2022) (succeeded in securing affirmance of order which granted client’s pre-answer motion to dismiss legal malpractice claims based upon statute of limitations grounds).
- Drasche v. Edelman & Edelman 201 A.D.3d 434 (1st Dep’t 2022) (succeeded in securing affirmance of order which granted client’s pre-answer motion to dismiss legal malpractice action for failure to state a claim based, in part, upon failure to viably plead proximately caused damages).
- Higgins v. TST Hudson, L.L.C., 179 A.D.3d 508 (1st Dep’t 2020) (succeeded in securing reversal of trial court order which granted summary judgment to Plaintiff under Labor Law 240(1) in catastrophic injury action, and in securing conditional summary judgment on client’s behalf with respect to indemnity cross-claims against other trades involved with injury-producing work).
- Fernandez v. City of New York, 148 A.D.3d 995 (2d Dep’t 2017) (succeeded in securing affirmance of order which granted pre-answer motion to dismiss in bodily injury action asserting maritime and Labor Law claims).
- Mr. PGP, LLC v. 10-15 Realty, LLC, 708661/2020 (Sup Ct. Queens County, 2020) (secured pre-answer dismissal in commercial matter arising from real estate dispute alleging breach of contract and breach of fiduciary duty claims against client).
