RMF Attorneys Douglas Nadjari and David Durso Presented At NYSBA’s Virtual CLE

Uniondale, NY – October 19, 2022 – Ruskin Moscou Faltischek, P.C., announced today that RMF Partner Douglas Nadjari and RMF Associate David Durso participated in a virtual CLE program hosted by the New York State Bar Association on Friday, October 14 entitled “Representing Healthcare Professionals in OPMC and OPD Investigations.” RMF Partner Douglas Nadjari, Co-chair of the Professional Discipline Committee, moderated the panel and RMF Associate, David Durso was one of the panelists and participated in the presentation Shelly Wang Bandago, Director of the NYS Department of Health, Office of Professional Discipline, Henry Weintraub, Chief Counsel of the NYS Department of Health, Bureau of Professional Medical Conduct and Dennis Spillane, Director of the NYS Department of Education, Office of Professional Discipline. The virtual CLE program covered topics on Jurisdiction & Investigatory Authority of OPD & OPMC, Anatomy of OPMC and OPD Investigations, and The Charging Process.   Two more programs are scheduled for February and May of 2022 and will focus respectively on administrative hearings and appeals and, the challenges lawyers face in representing impaired professionals.

The virtual CLE program covered topics on Jurisdiction & Investigatory Authority of OPD & OPMC, Anatomy of OPMC and OPD Investigations, and The Charging Process.

Mr. Nadjari is a member of the firm’s Health Law Regulatory Department and White-Collar Crime & Investigations Practice Group. Mr. Nadjari has 35 years’ experience as a trial lawyer concentrating in criminal defense, regulatory enforcement and commercial litigation. Mr. Nadjari regularly represents physicians and other health professionals in criminal matters, in civil litigation, before myriad government agencies, in medical staff proceedings, audits and commercial disputes. Mr. Nadjari serves as co-chair of the Professional Discipline Committee of NYSBA Health Care Section and is a member of the Tulane University School of Law Criminal Law and Procedure “Boot Camp” faculty. Mr. Nadjari also serves as a Chairman of the Board of Directors for the Island Harvest Food Bank and is a member of the Board of Advisors to the L.I. Energeia Partnership.

Mr. Durso is a member of the firm’s Health Law: Regulatory, Health Law: Transactional and Corporate & Securities Departments, as well as the firm’s White Collar Crime and Investigations, and Cybersecurity and Data Privacy practice groups. Mr. Durso’s work primarily focuses on health care professionals and companies in matters involving the Office of Professional Medical Conduct (OPMC), Office of the Inspector General (OIG), and the U.S. Drug Enforcement Administration (DEA). He also represents health care professionals and companies in hospital medical staff proceedings, audits, claw-backs, and demands for repayment made by Medicare, Medicaid, and private health insurers. David also represents corporations and individuals in criminal actions and government investigations. Mr. Durso is a member of the Board of Directors of Contractors for Kids, a Long Island charity that provides financial assistance to families with sick children. Mr. Durso is also a member of the Nassau County Bar Association and the New York State Bar Association.
