Adam L. Browser and Michael A.H. Schoenberg achieved significant victory for a client suffering from Multiple Sclerosis

Uniondale, N.Y. – March 16, 2023 – RMF announced today that attorneys Adam L. Browser and Michael A.H. Schoenberg achieved a significant victory for a client suffering from Multiple Sclerosis. The victory restores RMF’s client’s medical benefits, which had been improperly terminated, and allows her to continue receiving her critical daily medication and treatment.

Over a decade ago, RMF’s client was diagnosed with Multiple Sclerosis, a chronic neurological disease with no known cure. While her condition forced her to stop working, she maintained her medical benefits from her employer.  Since then, she has been treated by an internationally renowned neurologist and has taken part in a clinical trial.

Last year, her (former) employer abruptly and improperly terminated her benefits claiming she had failed to timely pay her insurance premiums. In terminating her benefits, the employer failed to give RMF’s client proper notice that a default had occurred, provided inconsistent information about the monies claimed due and failed to give her any meaningful opportunity to remit payment. RMF’s client was left without insurance coverage, medical providers were declining to treat her and the stress of the situation exacerbated her medical condition.

RMF pursued an administrative appeal of the termination of benefits. After an initial, perfunctory denial, RMF filed a second appeal, which was granted.  RMF’s client’s medical benefits have been restored, retroactive to the date of termination.  Now, she can continue receiving the treatment and medication she needs.
