Seattle’s King County Superior Court Upholds Small Aerospace Manufacturer Claim That 80 Billion Dollar Primus International Wrongfully Terminated Contract
Uniondale, New York – December 23, 2015 – The litigation team at Ruskin Moscou Faltischek, led by Senior Litigation Partner E. Christopher Murray, won a decisive victory in King County Superior Court in Seattle, Washington, on behalf of its client, Joka Industries, based in Bohemia, New York, in a lawsuit filed against Seattle area based Primus International, Inc., a multinational aerospace company owned by PCC Aerostructures.
In the lawsuit, Joka Industries asserted that a long term requirements contract specifying that Joka would sell Primus International a key component of a door Primus was manufacturing for Boeing 737s was wrongfully terminated by Primus when the company moved its manufacturing of this product in-house.
In a December 21, 2015 verdict, a jury awarded $1.3 million, the profits Joka International would have earned if the contract was not terminated. The jury found that Primus International wrongfully terminated its contract with Joka Industries, a niche aerospace manufacturer.
“Joka Industries represents the smaller, remaining types of aerospace manufacturers on Long Island and it is important that their rights be protected when they deal with the larger aerospace companies” said Murray, who spearheaded the prosecution against Primus International, Inc. “Primus International is a substantial supplier to Boeing and other worldwide commercial aerospace manufacturers where contracts must be enforced.”
The winning decision for Ruskin Moscou Faltischek came after a six day trial where Murray prevailed despite the fact that he was litigating in a Seattle Court against a leading Seattle law firm. “Trying the case in Seattle gave the Seattle based defendant, Primus, the inherent home town advantage,” asserted Murray. “The fact that the jury voted in our favor sends a clear message to larger aerospace manufacturers on their contractual dealings with smaller companies.”
