Uniondale, Long Island, New York, June 8, 2016 – Ruskin Moscou Faltischek, P.C. announced today that partner, Douglas M. Nadjari, and Of Counsel, Andrew T. Garbarino, presented a program to the Nassau County Bar Association Health and Hospital Law Committee, entitled Government Investigation of Controlled Substances: Representing Health Care Entities & Providers on June 2, 2016.
The program addressed current investigative trends and some of the pitfalls associated with responding to an investigation, as well as representing physicians, hospitals and other entities in connection with government investigations of their practices with respect to dispensing and prescribing controlled substances. It explained how prescription controlled substances, particularly opioids to treat pain, have been linked to the current heroin epidemic and even an increased suicide rate. Federal, state and local prosecutors have all devoted resources to the aggressive prosecution of doctors who essentially act as drug-dealers, often with good reason. However, a new disturbing trend is that now, prosecutors appear to be shifting toward the prosecution of professional judgment that would normally be left to administrative discipline.
Mr. Nadjari’s work primarily involves matters of professional discipline before the Office of Professional Medical Conduct (“OPMC”) and the Office of Professional Discipline (“OPD”). A major segment of his practice is devoted to the representation of clients in criminal and civil matters before the United States Attorney’s Offices, the FBI, OIG, OMIG, N.Y.S. Attorney General, local district attorneys, and other government agencies.
Mr. Garbarino represents clients ranging from international corporations to individuals, professionals and lay-people, in criminal and administrative actions.
