RMF ATTORNEY PRESENTS PROGRAM TO THE NASSAU COUNTY BAR ASSOCIATION HOSPITAL AND HEALTH LAW COMMITTEE
Uniondale, New York, April 9, 2019 – Ruskin Moscou Faltischek, P.C. announced today that Associate, David F. Durso, presented a program to the Nassau County Bar Association Hospital and Health Law Committee, entitled FDA Investigation and Prosecution of physicians for non-FDA approved substances; How to ensure that your clients spot the “red-flags” and comply with FDA regulations on April 4, 2019.
The program addressed the issues surrounding the importation of non-FDA approved drugs into the United States. Physicians are often solicited by non-FDA approved distributers that sell “misbranded” drugs from overseas. The program explained the “red-flags” that physicians can look for and steps that they can take to ensure that they are only purchasing legitimate FDA approved drugs from an FDA approved distributor. Physicians that purchase non-FDA approved drugs from overseas face criminal prosecution as well as civil liability for the possession and administration of these “misbranded” drugs and biologicals.
David is a member of the Health Law Department and the White Collar Crime and Investigations Practice Group. David represents health care professionals in disciplinary matters involving the Office of Professional Medical Conduct (OPMC) and the Office of Professional Discipline (OPD). He also represents health care professionals and companies in medical staff proceedings, audits, claw-backs, and demands for repayment made by Medicare, Medicaid, and private health insurers. David represents individuals and companies in investigations by the Office of the Inspector General (OIG), the Federal Bureau of Investigation (FBI), the Food and Drug Administration (FDA) and the U.S. Drug Enforcement Administration (DEA), as well as in prosecutions by federal, state, and local prosecutors’ offices.
