RMF Attorney Sheryl P. Giugliano Named Chair the Chapter 11 Lawyers’ Advisory Committee for the US Bankruptcy Court for the Eastern District of New York

Uniondale, NY – October 29, 2021 – Ruskin Moscou Faltischek, P.C., announced today that Partner Sheryl P. Giugliano has been named Chair of the Chapter 11 Lawyers’ Advisory Committee for the US Bankruptcy Court for the Eastern District of New York.  Membership in this prestigious Advisory Committee is by invitation only. The Chair is selected by the Chief Judge for the Bankruptcy Court. Ms. Giugliano has been an active member of the Committee since 2018.

The purpose of the Advisory Committee is to provide a forum for communication and feedback between the Board of Judges and the bar regarding Chapter 11 practice and procedure with the goal of better serving the needs of individuals and business entities seeking reorganization and of other parties in interest in Chapter 11 cases in the District.

Ms. Giugliano is a Partner in the firm’s Corporate Restructuring & Bankruptcy Practice Group, Corporate & Securities Department, and the Commercial Litigation Department. Her clients include middle-market companies facing operational or litigation issues, guiding them through the Chapter 11 or Chapter 7 process to a successful reorganization or liquidation. Ms. Giugliano represents trustees and receivers in the analysis and recovery of assets and prosecution of litigation claims, and secured and unsecured creditors with enforcing their rights to extend financing or consent to the use of cash collateral. In addition, Ms. Giugliano has represented contract counterparties negotiating for the highest possible cure payment or claim, defendants in preference and fraudulent conveyance actions, both in bankruptcy litigation and negotiating settlements to avoid protracted litigation, and purchasers in bankruptcy auctions.

As a member of the Corporate & Securities Department, Ms. Giugliano represents both early stage and middle market businesses on a variety of financial and other legal issues, including mergers and acquisitions, financings and other complex business transactions and agreements. In addition, she advises clients with respect to corporate governance issues and related matters. As a member of the Litigation Department, Ms. Giugliano represents parties in bankruptcy litigation and general commercial matters including contract disputes in state and federal court, arbitrations before the American Arbitration Association and JAMS, and mediations.
